NORTH EAST INDIA DEVELOPMENT PARTY

ARTICLE-I :Name of The Party

The name of the party shall be “North East India Development Party” hereinafter referred as the Party falling within the provisions of the representation of the People’s Act 1950 and subsequent amendments uptill now.

The registered Head Office of NEIDP shall be at SagolbandTeraLoukrakpamLeikai, Imphal West – 795001, Manipur.

The Flag of NEIDP shall be with White background with seven colours of stars (black, red, white, blue, Yellow, green and violet) arranged in numerical 8 (eight) shape in the middle of the flag.

Symbolic meaning and significance of the flag –

  1. White background stands for TRUTH
  2. Number of STARS stand for North East region of our country namely seven Sisters.
  3. Numerical 8(Eight) shape stands for unity amongst the stars and the colours.
  4. Seven colours stand for the natural gift bestowed to the Seven Sisters.

ARTICLE-II :Objective of The Party

  1. North East India Development Party is a political party within the meaning and provisions of the representation of the People Act, 1951 and all subsequent amendments till date.
  2. North East India Development Party (NEIDP) shall bear true faith and allegiance to the Constitution of India as by law established and to the principles of socialism, secularism and democracy and would uphold the sovereignty, unity and integrity of India.
  3. The party shall strive hard to uphold the political, social and economic rights as provided under the Constitution of India.
  4. The party is committed to the task of building a developed democratic India based on principle of equal opportunity to all the citizens. The Party will lay special emphasis on improving the condition of socially and economically disadvantaged sections of the society in order to build an India based on lofty objectives of our freedom struggle and Gandhian Principles.
  5. The Party will endeavor to campaign against evil influence of money power and muscle power vitiating the democratic politics.
  6. The party will pursue a policy of social and economic justice and development. It believes in Gandhian concept of decentralization of power so that the fruits of development could be made available to all the citizens. It also believes in peaceful and democratic forms of expression of dissent.
  7. The Party is firmly committed to secularism and is against the concept of a theocratic state.
  8. The Party shall be ever ready to fight against all forces that threaten to disrupt the unity and integrity of India.
  9. The Party will achieve its objectives through peaceful and democratic forms of campaigns like meetings, seminars, conferences and rallies. It will also raise the contemporary issues affecting common citizens during election campaigns.
  10. The Party will contest the elections conducted by the Election Commission of India, within five years of its registration and thereafter will continue to contest.
  11. The Party declares that it will not in any manner promote or instigate or participate in violence.
  12. The Party shall work ceaselessly to promote peace, progress and communal harmony amongst the people of North East India and shall make utmost endeavour to promote fraternity, tolerance and harmony with all the other communities of our country.
  13. The Party shall give due recognition to the principle of human dignity and the party shall fight in a non-violent, democratic and peaceful manner against all kinds of injustice and inequality perpetrated on grounds of caste, colour, creed, religion and gender.
  14. The Party shall work for the interest and welfare of the backward and depressed communities, constitutional rights of the scheduled castes, scheduled tribes and other backward classes.
  15. The Party is committed to uphold the age-old traditions, customs and rich cultural heritage of different ethnic communities of the North Eastern states.

ARTICLE-III: A: Membership

  1. All Indian citizens above the age of 18 years shall be eligible for primary membership of the party but only after making a written declaration affirming faith in Article II of the Constitution of the party i.e. objectives provided that he or she is not a member of any other political party registered with the Election Commission at the time of enrollment/joining.
  2. Indian citizens who are convicted by any Court of Law or associated with criminal gangs and who have committed social, political or economic offence are not eligible for membership of the party.
  3. There shall be no discrimination in the matter of admission of members to the party. The admission to the party is open to all adults irrespective of caste, creed, colour, religion and gender.
  4. Those qualifying for primary membership of the party shall have to pay membership fee of Rs. 50/- (Rupees fifty only) per year and have to renew their membership by 31st March every year.
  5. To be considered eligible for Active membership a member must have been a primary member of the party for a period of atleast one year and should be responsible for enrolling 10 members.
  6. Membership shall cease by death, resignation, removal or non-payment of fee.
  7. If any member is found engaged in anti-party activities or guilty of serious breach of discipline, he or she shall be served a show cause notice explaining the reasons and circumstances as to why disciplinary action is required to be taken against him or her. The show cause notice shall also announce the temporary suspension of the erring member.
  8. Any member can be removed from the party after the internal enquiry committee constituted by the President of the party in joint consultation with the various organs of the party to look into the complaint recommends such termination of membership or removal from the party based on admissible evidence, Sufficient opportunity shall be provided to the accused member suspected of anti-party activities to explain his or her version before the committee.

ARTICLE-III: B: Preparation of Rolls of Primary and Active Members

  1. The District Unit shall, before the 31st of March, in every four years, publish the preliminary roll of primary and active members enrolled or renewed during the previous terms. The revised and final roll, after scrutiny shall be published not later than the 31st of August every fourth year.
  2. The final roll published as above shall be in force till the next roll is prepared.
  3. Permanent lists of registers of active members shall be prepared by District Executive after being duly certified by the State Executive.
  4. Lists of primary members shall be maintained by District and subordinate Committees after being duly authorized by the State Executive.

ARTICLE-IV: Organs of the Party (Organizational Structure)

The Party, to start with, will be a state level regional party in Manipur extending its activities to all the North Eastern states (Seven Sisters). However, if situation so demands in future, it will be extended to other regions of India and at national level through proper amendment in the Constitution with due intimation to the Election Commission of India.

A. North East India Development Party shall have the following committees :

  1. Central Working Committee.
  2. State Executive Committee.
  3. District Working Committees.
  4. Constituency Level Committees.
  5. Block Level committees.

B.North East India Development Party shall have the following cells. Each cell shall have a convener who will directly report to the President.

  1. Economic Affairs Cell
  2. Foreign Policy Cell
  3. Media Cell
  4. Women’s Cell
  5. Students’ Cell
  6. Lebour Cell
  7. Farmers’ Cell
  8. SC & ST Cell
  9. Minorities Cell
  10. Ex-Servicemen Cell
  11. Human Rights Cell
  12. Legal Cell

The above mentioned cells will co-ordinate between the Party and the masses and popularize the policies and programmes of the Party to the people and gather feedback from the public to be placed before the Party.

The Party President is authorized to call and convene emergency meeting of the various cells depending upon the urgency.

The President shall be the head of the Central Working Committee, the highest policy and decision making body of the party and shall enjoy power to nominate members to the Central Working Committee as well as special invitees in due consultation with the various organs of the party.

The President shall convene and preside over all the meetings of Central Working Committee. In his absence one of the Vice Presidents nominated by the President is authorized to convene and preside over the meetings of Central Working Committee.

The Central Working Committee shall meet once in two months and emergency meeting of the Committee can be convened by the President at any point of time giving 24 hours prior notice to each member.

General Convention of the party

The General Convention of the party shall be held once in every year. It shall take various decisions and also assess the performance of the party and the feedback received from the public.

The Party Convention

The party convention shall be held once in a year and the CWC in responsible for conducting the party convention and to make the required arrangements.

Conduct of Elections Within The Party

The party shall hold periodic elections to the various positions of office bearers and the organs of the body atleast once in (4) four years as per details below.

Powers and Functions of Central Working Committee

The Central Working Committee is responsible for framing all the policies of the Party and also responsible for implementation of the aims and objectives of the Party.

Central Working Committee is authorized to make amendments to the existing rules and regulations in order to implement the policies and programmes of the Party from time to time.

Central Working Committee shall function as the guide to the Party and navigate it in the implementation of the various policies and programmes.

Central Working Committee is responsible for maintenance and enforcement of discipline within the Party.

Central Working Committee shall be responsible for the smooth conduct of the day today affairs of the Party. The term of the Central Working Committee is for a period of not more than five years.

State Council and Executive Committee

  1. State council shall consists of –

  4. State Council can be constituted only if atleast 50% of District councils are constituted.

State Executive Committee

  1. The State Council shall elect a President and State Executive Committee of maximum of 75 members from among its members.

  4. Powers and Functions of the State Executive Committee :
    1. The State Executive Committee shall work in perfect co-ordination with the Central Working Committee and implement the policies and programmes of the party at the State level in co-ordination with the Districts, Constituency and Block Level Committees.
    2. The State Executive shall function as the bridge between the Central Working Committee and various state level organs of the party.
    3. The State Executive shall ensure smooth functioning of the daytoday affairs of the party at the state level.
    4. The State Executive Committee shall keep the Central Working Committee updated and informed of the public response the feedback from workers in order to remove deficiencies if any in the party’s programmes and their implementation.
    5. The period of the State Council and the Executive Committee shall not exceed a period of three (3) years.

District Working Committees

The Party shall have District Working Committee for each District of the state with office bearers as below.

District President and District Committee

The president is empowered to appoint District President as well as the other office bearers of the District Committee in consultation with the Central Working Committee and the District President. The tenure of office of the District Working Committee shall be for a period of two and half years.

District Working Committee – Powers and Functions:

  1. Each District Working Committee shall be responsible for the day today affaires of the party in their respective district.
  2. Each District Working Committee shall take the party’s agenda and programmers to the people in the District by forming Block Level committees throughout the District in consultation with the state committee and the central working committee.
  3. The respective District Working Committee is responsible for ensuring party discipline in their territory and also for safe keeping of the party’s documents at District level.
  4. The respective District Working Committee is empowered to set up town or Constituency level committee.
  5. The respective district working committee is empowered to process applications from the public for membership of the party and submit them to the president for approval in consultation with the state committee and the CWC.
  6. The respective District Working Committee is empowered to renew the membership of the Party and to collect annual membership fees from the public in consultation with the State Committee and the CWC. Receipts in lieu of membership fee collected shall be issued to the enrolled members.
  7. The respective District Working Committee shall meet once in a month and attendance of two-third members in compulsory.

Constituency Level Committee

The Party will have Constituency Level Committee for each one of the total number of Assembly segments in the state concerned. The President is empowered to appoint the Head of this Committee in consultation with the respective District Presidents of the Party. The number of members of this committee of each Constituency and also population of each Constituency.

Block Level Committee

The District Working Committee of the Party is empowered to constitute Block Level Committee throughout the concerned state in consultation with the State Committee and the CWC. The term of office of the Block Level Committee shall be for a period of two years.

Advisory Board

The President is authorized to constitute an Advisory Board not more than fifteen Members drawn from the civil society to advise and offer expert suggestions to the President in all matters concerning the Party. Such Advisory Board shall be constituted in consultation with the various organs of the Party.

Parliamentary Board

The President of the Party shall also function as Chairman of the Parliamentary Board. He is also authorized to appoint other members to the Parliamentary Board and the number of members shall not exceed twelve. Such members shall be appointed in a transparent and democratic manner and in due consultation with all the organs of the party.

The functions of all above organs of the Party shall be conducted in a true democratic spirit of the party firmly declares that there is “NO” provision in the constitution for “Veto power” by any organ of the party or its office bearers.

The party firmly resolves that not more than one third members can be nominated and no tenure of any organ or its bearers shall exceed a period of five years maximum from the date of constitution of such organ and its office bearers.

The party also firmly resolves that periodic elections shall be held within four years to all positions of office bearers and organs of the Party.

ARTICLE-V: I: Office-Bearers of the Party

President – Power and Functions

  1. The President is authorized to convene the Central Working Committee meeting and to preside over them.
  2. He is authorized to nominate all the office bearers of the Central Working Committee and also decide their numbers but in due consultation with the other organs of the party and based on merits and performance.
  3. The President is authorized to withdraw appointment of office bearers of the Central Working Committee or any other Committees as and when the occasion demands and such action shall be taken only in consultation with the other organs of the party.
  4. The President is authorized to remove or suspend any office bearer or bearers of the Central Working Committee or any other Committees if needed considering the interest of the Party but only after obtaining the majority view and unanimity from the other organs of the party.

Election of President

  1. For conducting election to the post of President, a Returning Officer shall be appointed Such Returning Officer shall not hold any office-bearer’s post at the State or Central level for four years after the elections. The Returning Officer shall appoint Presiding Officers and make arrangements for the poll.
  2. Presiding Officers shall forward the ballot boxes to the Returning Officers. After the receipt of all the ballot boxes, the returning officer shall count the votes of each candidate in presence of one observer from every candidate.
  3. The election of President of the Party at State, District and Block levels will take place in the similar manner through free, fair and democratic manner.

Resignation of the President

The President can resign from his post at any time during the tenure of his office without assigning any reason but shall hand over the responsibilities to any one of the Vice President of the Party. The President shall always be eligible for reelection as President if he desires so.

Removal of the President

The President can be removed by the Central Working Committee by tabling a motion of no-confidence by two third of it’s members present at the voting but a prior notice of thirty days is required to be served by atleast one third of the members of Central Working Committee.

Vice President

In the absence of the President of the Party,the Vice President nominated by the President is authorized to perform his duties and exercise all the powers of the President.

General Secretary

  1. The President is authorized to nominate or appoint General Secretary (S) of the Party who is responsible to supervise the affairs of the Party as per the rules framed and as per the directions of the President of the Party.
  2. The General Secretary (s) shall be responsible for safe keeping and custody of all the relevant documents of the Party. Further, the General Secretary (s) shall be responsible for conducting all the Party meetings in consultation with the President apart from preparing minutes and proceedings of all meetings. They are also responsible for handling all the correspondence and communications of the Party. The General Secretary (s) shall have the power to inspect, supervise all activities of the District, Constituency and Block Level Committees in the interest of the Party.

Joint Secretary

The President shall appoint Joint Secretary (s) of the Party who shall function under the General Secretary of the Party.

Propaganda Secretary

The President shall appoint Propaganda Secretary who carries the responsibility of giving publicity to the policies and programmes of the Party. The Propaganda Secretary is the bridge between the Party and the masses for effective implementation of the party’s ideology, policies programmes and manifesto.

Treasurer

The Treasurer is the custodian of the Party’s fund and shall be responsible for maintaining the accounts of the Party. He is authorized to open bank account for safe keeping of the party fund with any nationalized bank in the state concerned. The Treasurer shall prepare annual statement of accounts of the Party in consultation with the President and place the same before the Central Working Committee for approval. He is authorized to maintain a cash balance of Rs. 25,000/- maximum to meet the day today expenses of the Party.

Plenary Session

  1. Plenary Session of the party shall be held once in four years at a place to be decided upon by the Central Working Committee.
  2. Members of Central Working Committee and District Executives along with members of the State Council and State Executive Committee shall be delegates of the Plenary Session of The Party.
  3. The Plenary Session shall consider resolutions, recommended to it for adoption by the State Executive Committee.
  4. It shall also consider and approve constitutional amendments if at least two third of the delegates vote in favour of such amendments.
  5. The District Committee in whose jurisdiction the Plenary Session is held shall act as the Reception Committee and may-co-opt additional member for the purpose.

The party firmly resolves that not more than one third members can be nominated and no tenure of any organ or its office bearers shall exceed a period of five years maximum from the date of constitution of such organ and its office bearers.

The party also firmly resolves that periodic and regular elections to all positions of office bearers and organs of the party shall be held atleast once in four years or earlier.

ARTICLE-VI: Rules of Dispute Resolution and Discipline

All disputes in the party shall be handled by the following two Committees constituted with the due approval of the President constituted after discussion and consultation with the other organs of the party.

  1. Dispute Resolution Committee
  2. Disciplinary Action Committee

These committee will take up various complaints received from members, public and authorities and make necessary recommendations based on investigation to the Central as well as the State level committees for further action and decision. The working of these committees will be transparent and the members accused/charged with indiscipline, working against the interests of the party/anti-party activities shall be provided enough opportunities to prove their innocence.

The Dispute Resolution Committee and Disciplinary Action Committee will not have more than seven (7) members.

ARTICLE-VII :Basics of Rules and Conduct of Business

  1. Decisions will be taken in all the committees on the basis of simple majority, where unanimity is not possible. However, constitutional amendments shall require two third majority for approval and shall have to be approved by the Central Working Committee/General Body/the highest policy and decision making body of the party.
  2. The quorum for all meetings of the various committees shall be one third of the strength of the respective committee.
  3. Due notice of at least 2 weeks shall be given for any meeting of the respective committee.
  4. Business/proceedings at all levels of the various organs of the party shall be conducted in a peaceful, open and democratic manner by giving opportunity to everyone to present his/her constructive views in a free and frank manner without fear of reprisal.

ARTICLE-VI: Rules of Dispute Resolution and Discipline

The Party will maintain a fund, the contributions for which will come from its members, supporters and well-wishers. Complete transparency shall be observed in respect of this fund which shall be used only for political activities related to the Party.

The party will submit its audited annual financial statement to the Election Commission of India within a period of six months of the end of each financial year. The audit of the party accounts will be conducted by an auditor empanelled with the CAG. The fund of the party will be used for political purpose only and the party will abide by the instruction issued by the Commission from time to time in the maintenance of its accounts.

The audited statement of accounts will also be submitted to Income Tax Authorities.

The treasurer of the party will be responsible for keeping regular accounts.

A Bank account shall be opened which will be operated jointly by President, Treasurer and one of the General Secretaries authorized by the President.

ARTICLE-IX: Party Constitution Amendment Procedure

The party undertakes that any amendment in the party constitution except Article II shall be made only after approval of the General Body/Central Working Committee/the highest policy and decision making body of the party by a majority of two-third of its members present and voting after due notice atleast two weeks in advance to all the organs of the party. Their views for and against any amendment shall be hard in a democratic and transparent manner before it is put to vote.

ARTICLE-X: Merger, Split and Dissolution Procedure

  1. Merger
  2. In special circumstances the party may merge with any other political party with similar aims and objective. The decision of merger will have to be taken by two third majority of the General Body/Central Working Committee/the highest policy and decision making body after circulating the resolution of merger to all State, District and Block level committees and after extensive discussion with these bodies. The resolution of merger will be placed before the General Body/Central Working committee/ the highest policy and decision for approval.

  3. Split/Dissolution
  4. If due to unavoidable circumstances the party has to split/dissolve, the decision will have to be taken by two third majority of the General Body/Central Working Committee/ the highest policy and decision making body in a special session. It the case of split/dissolution all the movable and immovable assets of the party will be divided according to the decision of the General Body/Central Working Committee/ the highest policy and decision making body after circulating the resolution of split/dissolution to all State, District and Block level committees well in advance with a notice of at least twenty one (21) days.

AARTICLE-XI: Party’s Allegiance to The Constitution of India

In keeping with Section 29A, sub-section (5) of the Representation of the People Act 1951 North East India Development Party shall bear true faith and allegiance to the Constitution of India as by law established and to the principles of socialism, secularism and democracy and would uphold the sovereignty, unity and integrity of India.
